Can The Government Confiscate My Firearms During a Disaster?

Can The Government Confiscate My Firearms During a Disaster?

Following the devastation caused by Hurricane Katrina in 2005, the New Orleans police went door to door seeking people who rode out the storm in their homes to force them to comply with the forced evacuation ordered by the government. As part of the effort, the officers were also confiscating firearms. This created outrage among the law-abiding gun owners of the country and resulted in the passage of state and federal laws to prevent such confiscations from occurring in the future.

In 2006, Congress passed the DISASTER RECOVERY PERSONAL PROTECTION ACT of 2006. The law was intended to prevent the government from seizing legally-owned firearms during the time of a disaster. It was incorporated as an amendment to the Department of Homeland Security Appropriations Act of 2007, and signed into law on October 4, 2006.

Isn't that sort of scenario why folks claim they keep firearms around, to resist and repel tyranny and all? How ironic it would be if they tucked tail and handed them over after all the bluster about cold dead hands and such.

to be fair, when you're surprised 3-on-1 by cops that want to take your gun from you... you give up your gun peacefully. better to fight it out in court later, because you will almost certainly win.
    trust me on this one.

Not in a disaster situation, we all have SHTF guns ready for a reason this being one. If someone is trying to consfication my firearms illegally this is a direct threat to my life and well being. I won't hesitate to defend myself and family from such a threat.

However, in reality I wouldn't allow myself and family to be in that situation to being with. I would not have stayed in the path of such storms. There is a reason I don't live in disaster prone regions.

    Not lawfully here in Michigan:
    MCL 10-31
    (3) Subsection (1) does not authorize the seizure, taking, or confiscation of lawfully possessed firearms, ammunition, or other weapons.
    MCL 30-405
    (2) Subsection (1) does not authorize the seizure, taking, or confiscation of lawfully possessed firearms or ammunition.

I would, more or less, agree. You would have the law on your side, if there is still a court to take things to after the crisis is over. You (each of us) would have to make that call based on the circumstances.

Can the government confiscate my firearms during a disaster? The government can do anything, at any time, they want regardless of any laws. They can justify any of their actions based upon any reasons that fit any situation. If laws a in place that prohibit them from confiscating you can challenge their illegal action in court, if you're alive.

    100% correct.
The answer to the question is YES.
They can do anything regardless of law.
