1-year-old recovering after being shot in leg
Mother's boyfriend will be arraigned in the case today

Ypsilanti Police Lt. Craig Annas said the man called for help about 2:15 p.m. Tuesday.

When police arrived at the woman's apartment in the 900 block of West Michigan Avenue, they found the 33-year-old man and his children with the woman, a 2-year-old girl and a 3-year-old boy.

The 1-year-old, who has a different father, was suffering from a .40-caliber gunshot wound to his upper leg. The bullet hit the outside of his leg and exited the inside of his thigh, police said.

He said the child's mother, who was away from home at the time of the shooting, asked that the boy's name not be released. He said she had left the children in the care of the man.

During questioning, Annas said, the man told police he heard about a fight down the street at a party store and left the children alone in the apartment to watch the fight and buy a beer, knowing there was a loaded handgun under a couch cushion. When he returned, he told police, the 3-year-old had shot the youngest child.

But the 3-year-old, Annas said, told police the man had shot the baby while he was putting the gun in his coat pocket. He said there was no evidence early Tuesday night to refute the man's story.

However, Annas said police had no reports of a fight at the nearby party store. Annas also said the man denied the gun was his, but the man has prior convictions, including a felony, that make it illegal for him to possess a firearm.

He said police will ask a prosecutor to authorize a second- degree child abuse charge, which amounts to reckless endangerment, a four-year felony. One count could be filed against him for each child, since all three were endangered by the loaded weapon in their reach.

He said prosecutors also could file a mandatory two-year felony firearm charge and a charge for being a felon in possession of a firearm. The man was scheduled to be arraigned today.
