Oh, here it is: SB 0384 of 2015 (http://legislature.mi.gov/doc.aspx?2015-SB-0384), give the director of the Family Independence Agency the ability to "appoint agents". I don't see any requirements for training, but give the "department" armed agents......

THEN, exempt them from pfz's.

Is there something wrong with this line of reasoning?

What I don't understand is why if they want their IG to be armed and have arrest powers, do they not hire fully certified/qualified MCOLES police officer and not someone in the office with a "oh by the way, you now carry a gun and can arrest".

This whole idea is bad, as if Michigan DHS does not have enough power already to screw with people and their families. Or is it because the local police are getting tired of being pulled into Michigan DHS battles?

The bill would create a police force within the MI Department of Health and Human Services. According to the current version of the legislation, agents of the MI Department of Health and Human Services would be granted limited arrest powers to enforce "RETAIL TRAFFICKING OF FOOD ASSISTANCE BENEFITS ADMINISTERED BY THE DEPARTMENT ACCORDING TO THE FEDERAL SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM."

In other words, the bill would create a "federal bureaucracy compliance" police force under the Department of Health and Human Services.

Actually... yes... and that's coming from someone who wants the smallest government possible.

Police all over the state are at their limits with what they have now. A specific unit that's part of HHS that is tasked with investigating and punishing the leeches that pull up to a shady party store in a newer Escalade and buy cheetos and booze with their EBT card is a good thing.

That would also have "qualified immunity", so when they start violating rights of citizens in arrest procedures, seizing property, stepping outside of the scope of the laws that they were formed to enforce, their victims would have no recourse.

Limited arrest powers for the sole purpose of combating welfare fraud.

Everyone screams and cries about welfare abuse but when they try and do something about it... everyone screams and cries.

(2) The director may appoint agents with limited arrest powers for the enforcement of <<retail trafficking of food assistance benefits administered by the department according to the federal Supplemental Nutrition Assistance Program.>> The agents appointed under this section are agents of the department office of inspector general and have all powers conferred upon peace officers for the purpose of enforcing the general laws of this state as they pertain to enforcement of this act. The director may authorize agents of the office of inspector general to carry a firearm.
(3) In addition to the limited arrest authority granted in subsection (2), an agent of the office of inspector general, while on duty, may arrest a person without a warrant if 1 or more of the following circumstances exist:

(a) The agent has <<probable>> cause to believe that a felony has been committed and <<probable>> cause to believe that the person committed it.
(b) The agent has <<probable>> cause to believe a felony offense for financial gain under section 159g(d) or 159g(e) of the Michigan penal code, 1931 PA 328, MCL 750.159g, has been committed and <<probable>> cause to believe that the person committed it.
(c) The agent has <<probable>> cause to believe that a felony offense under section 300a of the Michigan penal code, 1931 PA 328, MCL 750.300a, has been committed and <<probable>> cause to believe that the person committed it.
(d) The agent has <<probable>> cause to believe that a felony offense using a fraudulent device to obtain relief under section 60 Senate Bill No. 384 as amended September 10, 2015 has been committed and <<probable>> cause to believe that the person committed it.
(e) The agent has received positive information by written, telegraphic, teletypic, telephonic, radio, or other authoritative source that a peace officer holds a warrant for the person's arrest.


Yep, limited power that is immediately expanded within a phrase or two.

Still without ANY training. How are they to know what constitutes "probable cause" and what is just a "possibility". It seems that there are LEOs here on this forum that can't seem to differentiate the two. The "felony" limitation in there is nothing, just about everything now-a-days is a damn felony.

Nothing is "impossible", yet many things are "improbable", hence not all possibilities are probable.

This is too much power placed into the hands of untrained bureaucratic "agents".
