MGO in Action - MUCC... Eliminate penalties for having a firearm ON a vehicle

    And another one....

On March 7th there will be a MUCC Quarterly Policy Board Meeting at the Ashley Sportsman Club (8554 S Mason Rd, Bannister, MI 48807) from 10:00 to 4:00

I will be speaking and presenting this resolution in order to rescind an outdated MUCC policy.
The outdated policy hindered the efforts of a pro 2A State Representative recently and it may come into play again.
If MGO's Proposed Resolution #S gets approved on 3/7/20, then I will be speaking in front of hundreds in June to get them to approve.

If you can join me on 3/20, please do! The MUCC committees meet from 10-noon, then lunch, then the voting begins.

At this time, this meeting does not afford MGO a vote, but I'm working on that between elections and appointments.

MGO has two votes at the June MUCC annual convention - we just have to get it there first!

This resolution will be a bit harder to get through. It will take a 2/3 majority to pass it because it requires MUCC to take action with the legislature and lobby to eliminate the "UPON a vehicle" language.

As Submitted for MUCC PB Consideration
    Proposed Resolution #U
    Requires 2/3rd Majority
Submitted by: JackAm, Michigan Gun Owners
    MUCC Region: 9

Proposed: March 7, 2020 Conservation Policy Board Meeting

Title: Work to change language in MCL that puts Michigan hunters and shooters in
    jeopardy of committing a crime

1 WHEREAS, Michigan statute regulates activities of hunters and outdoor enthusiasts; and

2 WHEREAS, under part 401, Wildlife Conservation, of the NATURAL RESOURCES AND

3 ENVIRONMENTAL PROTECTION ACT (MCL 324.40111) it is unlawful for a hunter or target shooter

4 to have an uncased firearm “in or upon” a vehicle; and

5 WHEREAS, most Michigan hunters and target shooters rely on a vehicle during hunting and target

    6 shooting activities; and

7 WHEREAS, whether loaded or unloaded, leaning a shotgun, rifle, or handgun on an open tailgate or using

8 a truck’s hood as a bench rest during target shooting can lead to fines, confiscation or both; and

9 WHEREAS, individuals that violate this section of law are guilty of a misdemeanor punishable by

10 imprisonment for not more than 90 days, and/or a fine of not less than $50.00 or more than $2000.00, along

11 with the cost of prosecution; and

12 WHEREAS, it is far easier for hunters and target shooters to utilize the bumper, tailgate or hood of a

13 vehicle than it is to lean their firearm against the closest tree to the parked vehicle during a break; and

14 WHEREAS, Michigan allows certain individuals to carry loaded weapons in vehicles, whether stationary

    15 or moving; and

16 WHEREAS, other states have recently removed similar language from their laws so that it is no longer a

17 crime to lean a firearm on a non-moving vehicle; and

18 WHEREAS, safely leaning or resting a shotgun, rifle, or handgun on a vehicle (tailgate, hood, etc.) or up

19 against a non-moving vehicle is not a safety hazard resulting in innocent shooters and hunters being cited

    20 for unintentional violations; NOW,

21 THEREFORE, BE IT RESOLVED, that Michigan United Conservation Clubs (MUCC) recognizes

22 leaning or placing a firearm on a non-moving vehicle should not be a crime

23 BE IT FURTHER RESOLVED, that MUCC work with the Michigan Legislature to actively pursue a

24 change in Michigan statute removing the prohibition concerning placement of firearms upon non-moving

    25 vehicles.

Thank you for all of your hard work on this.

    Just a quick update....

Things went GREAT at the MUCC Policy Board last Saturday.

MGO presented two firearm related resolutions that we wanted to become MUCC policy and they were both overwhelmingly approved to go to the MUCC annual convention for a final vote.

MGO Members can see the details HERE but the synopsis is that there was zero opposition to eliminating the word "UPON" in the law.

Once I present it and get a successful vote in June, then MUCC will work on lobbying on gun owner's behalf to eliminate the stupid language from the statute and one day we can lay a rifle on a tailgate and not be breaking a law.

We also got an unopposed vote (to send a resolution to the annual convention for final approval) on two tie-barred resolutions that were long standing MUCC policies to require all guns be encased in a vehicle, inaccessible, and in the trunk. This language HURT us firearm owners in recent legislation. After June, with fingers crossed that it passes and gets rescinded, it will never hurt us again.

For those that are not MGO members, this kind of stuff is worth the $25 as it will directly affect and benefit you as a firearm owner. Please consider it.
